Requirement in other legislation

In Sweden, there are requirements in other legislation than the Act on Tobacco Free Nicotine Products that applies to tobacco free nicotine products.

• CLP and Reach regulation and general rules for chemical products. If you have questions about CLP and Reach regulation or general rules for chemical products and how they may be applicable on tobacco free nicotine products, please contact the Swedish Chemicals Agency.
• Excise duty. If you have questions about excise duty regarding tobacco free nicotine products, please contact the Swedish Tax Agency.
• Snus-like products. In the Food Act “snus-like products” are equated with food. For example, a “snus-like product” can be a tobacco free nicotine product if it is used in a way that corresponds to snus consisting of tobacco. If you have any questions about food legislation, please contact the Swedish Food Agency.

Prohibited products that can pose a serious risk

If we establishes or has reasonable grounds to believe that:

• a specific tobacco free nicotine product, or
• a type of tobacco free nicotine product

may pose a serious risk to human health, may we prohibit the product from being provided to consumers on the Swedish market. This applies even if the product meet all legal requirements in the Act on Tobacco Free Nicotine Products.

We have not prohibited any tobacco free nicotine products based on a serious risk to human health. If we were to prohibit a product on this basis, information about the product will be published when it gains legal force.
