Requirements on electronic cigarettes and refill containers

Electronic cigarettes and refill containers intended for consumers on the Swedish market must comply with the rules in the Act on Tobacco and Similar Products and other relevant legislation. For example the CLP and Reach regulation.

Requirement in other legislation

In Sweden, there are requirements in other legislation than the Act on Tobacco and Similar Products that applies to e-cigarettes and refill containers.

  • CLP and Reach regulation and general rules for chemical products. If you have questions about CLP and Reach regulation or general rules for chemical products and how they may be applicable on e-cigarettes and refill containers, please contact the Swedish Chemicals Agency.
  • Excise duty. If you have questions about excise duty on certain nicotine goods, including e-liquids and other nicotine goods, please contact the Swedish Tax Agency.
  • Product Safety. The regulation in the Product Safety Act also applies to e-cigarettes and refill containers.
  • Safe and interference-free electricity. If you have questions about safe and interference-free electricity and how they may be applicable on e-cigarettes or parts of e-cigarettes, please contact the National Electrical Safety Board.

Requirements in the Act on Tobacco and Similar Products

  • Notification on electronic cigarettes and refill containers

    Both manufacturers and importers of electronic cigarettes and refill containers are required to notify and pay a mandatory fee for each product intended to be available to consumers on the Swedish market. This means that the product must be notified by each individual importer, even if it already has been notified by the manufacturer. Each year you must also fulfil the annual reporting obligation for your notified products.

  • Product requirements on electronic cigarettes and refill containers

    Electronic cigarettes and refill containers must meet set product requirements when provided to consumers on the Swedish market. For example, products have to be child- and tamper-proof and must not contain nicotine in excess of 20 mg/ml.

  • Labelling requirements on electronic cigarettes and refill containers

    Electronic cigarettes and refill containers that are available to consumers on the Swedish market must carry health warnings and a content declaration in Swedish on its packages. Unit packets of these products must also include a leaflet with information in Swedish.
