Tobacco free nicotine products
Tobacco free nicotine products are regulated by the Act (2022:1257) on Tobacco Free Nicotine Products. This legislation regulates product notification, product requirements, sales and marketing of tobacco free nicotine products.
Parts of the regulation on tobacco free nicotine products will enter into force after 1 August 2022, which means that the regulation and its transitional provisions will be fully implemented on 1 February 2024.

The purpose of the legislation of tobacco free nicotine products is to limit the health risks associated with the use of tobacco free nicotine products.
What is a tobacco free nicotine product?
A tobacco free nicotine product is a product without tobacco that contains nicotine for consumption.
Products that are not covered by the Act on Tobacco Free Nicotine Products
The following products are not classified as tobacco free nicotine products according to the Act on Tobacco Free Nicotine Products:
- Nicotine-containing products not intended for consumption.
- Tobacco products, herbal products for smoking and electronic cigarettes and refill containers. These products are regulated by the Act on Tobacco and Similar Products.
- Tobacco free nicotine products classified as a narcotic drug or a substance harmful to health. These products are regulated by the Penal Law on Narcotics or the Prohibition of Certain Goods Dangerous to Health Act.
- Hexahydrocannabinol (HHC) is covered by the Penal Law on Narcotics.
- Medical products or medical devices that is covered by the Medicinal Products Act or Act with Supplementary Provisions to Regulations (EU) on Medical Devices.
The Swedish Medical Products Agency says that:
- Cannabidiol (CBD) is covered by the Medicinal Products Act.
- Tetrahydrocannabinol (THC) is covered by the Penal Law on Narcotics.

Smoke-free environments
In Sweden, it is prohibited to use tobacco free nicotine products which in their use resemble smoking in certain indoor and outdoor environments, so-called smoke-free environments.
If the rules are not followed
Only tobacco free nicotine products that comply with the Act on Tobacco Free Nicotine Products may be made available on the Swedish market. A regulatory authority can decide on injunction or prohibition, with or without a fine, if a non-compliant tobacco free nicotine product is made available on the Swedish market, or if the sale of tobacco free nicotine product is non-compliant with the regulation.
